OPINION AND ORDER

HEWITT, Judge.

This dispute arises out of a 1985 contract for berthing improvements to a naval dock at the Mayport, Florida Naval Station.1 The case is before the court on the parties’2 motions for summary judgment and their respective oppositions thereto.

The dispute focuses on two issues. The first issue involves a liquidated- damages provision in the contract. Safeco contends that the provisions governing the rate and the calculation of damages, if enforced according to the government’s interpretation, would be illegal as a penalty.
