Plaintiff,.Eugene M. Tupponce, brought this action in trespass to recover damages for personal injuries alleged to have been caused by thé negligence of defendant, Pennsylvania Railroad Company. A jury trial resulted in a verdict of $20,000 for plaintiff. After defendant’s motion for judgment n.o.v. was denied by the court en banc, and its motion for a new trial was granted, both parties appealed.
