Plaintiffs Western Wood Preservers Institute, Treated Wood Council, Southern Pressure Treaters’ Association, Creosote Council, and Railway Tie Association (“plaintiffs”) sued John M. McHugh in his official capacity as the Secretary of the Army, the United States Army Corps of Engineers, and Rebecca Blank in her official capacity as Acting Secretary of Commerce (“defendants” or “Corps”).
