MEMORANDUM OF DECISION

This litigation arises out of the state's right of eminent domain as exercised through the Commissioner of Transportation. On June 15, 2001, the Commissioner filed a Notice of Condemnation together with an Assessment of Damages in the amount of one thousand ($1000) dollars for the acquisition of a forty-four one hundredths (0.44) acre of land which is a wedged-shaped, unimproved parcel situated in the town of Kent and is a portion of a larger three (3) acre "tract."
