after stating the case: It is not urged against this legislation that its acceptance was made to depend upon the vote of the people within the new school district. Such legislation has so often been sustained in this State that it is no longer an open question. Cain v. Commissioners, 86 N. C., 8. Nor is it suggested that any but those who were qualified voters of the territory took part in the election, nor 1hat any who were such electors in the territory were denied registration.
