A criminal proceeding upon a charge of assault and battery was instituted against the plaintiff on the 8th day of March, 1924, in the city court of Logan City, Cache county, Utah. Plaintiff appeared, and upon proper affidavit seasonably filed in said court demanded that the cause be tried before some other judge or justice of the peace of the same county having concurrent jurisdiction, in pursuance of the provisions of Comp.
