I. The defendants, appellants, are physicians and surgeons, and this is a malpractice case. The charge is that the defendants operated upon the plaintiff for appendicitis, and in doing so, negligently cut nerves, tissues and muscles of plaintiff's body so that, as a result, his right leg became atrophied and useless. The defendants, in addition to a general denial, and after admitting that they were physicians and surgeons, pleaded as a bar the Statute of Limitations — the act approved March 29, 1921 (Laws 1921, pp. 197, 198).
