Since this case is before us a second time, a summary of the previous litigation would be salutary. Tsetsy Pangarova, a niece of Nick A. Nichols, deceased, after having unsuccessfully challenged decedent’s will in which she was not named as a beneficiary, brought an action in 1963 against the executrix of decedent’s estate for dam*758ages growing out of breach of a contract that decedent would adopt her and make her his heir.
