Tidball, District Judge.

On February 11, 1933, an explosion took place in the basement of a building in Sheridan occupied by the City Furniture & Paint Company store. The furniture company was not the owner but the lessee of the building. The explosion was tremendous, resulting in breaking glass, dislodging plaster, and cracking the building in question. At the time, plaintiff Brouilette and W. L. Ashton, plaintiff in a companion case, were in the basement and were injured, by the explosion.
