This was an action arising out of a contract entered into between the defendants Rollins & Jarecki and the county of Los Angeles for the furnishing of the materials and performing the work necessary to the proper construction of the Santa Susanna Pass Highway in said county. The defendant and appellant American Surety Company of New York furnished the bond of said contractor for the due performance of the terms of said contract.
