At various dates dur- ■ ing the year 1916 the superintendent of the streets of the city of Phoenix, Arizona, entered into four separate contracts with the California-Arizona Construction Company, hereinafter called the Construction Company, for the improvement of certain streets of that city. These contracts were made pursuant to the provisions of the Improvement Act of 1912 (chapter 13, tit. 7, Rev. Stats. Ariz. [Civ.
