This is an action brought to recover premiums upon two policies of indemnity insurance issued by the plaintiff, Home Accident Insurance Company, to the defendant, Carl Pleasant. One was a workmen’s compensation and employer’s liability policy, given to secure compensation to defendant’s employees employed by him in the construction of a dam for the impounding of the waters of the Agua Fria River and other construction incident thereto.
