OPINION

HORN, Judge.

This is the second opinion issued by this court in this Winstar-related case. See Standard Fed. Bank v. United States, 51 Fed.Cl. 695 (2002). In a fihng submitted to the court, the defendant stated that it had “determined based upon the facts in this case and established legal principles, not to contest the existence of a contract or breach.” The defendant, however, also stated: “[W]e do not concede that the breach caused any damages or that the named plaintiff is the real party in interest.” On February 25, 2002, this court issued an opinion, granting plaintiffs motion for…
