Plaintiffs, husband and wife, residing in Kent county, claim damages as the result of an automobile accident which occurred on a public highway in Kent county, Michigan, on June 13, 1956. At the time of accident defendant was also a resident of Kent county.

The day before the expiration of the 3-year statute of limitations period, namely, June 12, 1959, suits were commenced by issuance of summonses which were placed in the hands of the county deputy sheriff for service. Declarations were filed the following June 25th.
