On September 5, 2002, the court issued a liability opinion in this Winstar-related case, holding that the United States, through the *112enactment of the Financial Institutions Reform, Recovery and Enforcement Act of 1989 (“FIRREA”), P.L. No. 101-73, 103 Stat. 183, breached an express contract with the plaintiffs (collectively the “Franklin Plaintiffs”) to treat the supervisory goodwill of Franklin Federal Savings Bank—a Tennessee thrift created in January 1989 by the supervisory conversion of Morristown Savings and Loan Association and its acquisition by Franklin…
