BLOCK, Judge.

This is a “Winstar” breach of contract case. It is an example of the many eases heard by this court which stem from the savings and loan crisis of the early 1980’s, Congress’ subsequent attempt to quell the crisis through passage of the Financial Institutions Reform, Recovery, and Enforcement Act of 1989, Pub.L. No. 101-73,103 Stat. 183 (“FIRREA”), and the United States Supreme Court’s decision in United States v.
