This is an appeal by the plaintiff from a decree of the circuit court which dismissed his complaint.

The subject matter of the controversy is a road of undisclosed length which lies in Columbia county and which the parties term a “CCC” road. The dispute between them centers in a part of the road which extends from the plaintiff’s home on the west to a county road on the east known as the Apiary-Nehalem Valley County Eoad.
