delivered tbe opinion of tbe court:
In tbis case tbe importers submit upon the record and finding of tbe board. Brief and argument are presented by the Government. Tbe merchandise consists of dyed schappe silk yarns and was assessed for duty under tbe provisions of paragraph 397 of tbe tariff act of 1909 according to tbe number of the yarns in tbe gray or original condition, against which tbe importers protested.
Tbe Board of General Appraisers, following their prior decision G. A. 7295 (T. D. 32002), held the goods should have been assessed according to tbe number of tbe yarns in…
