Factual and Procedural Background

Plaintiff, Meteoro Amusement Corp. (“Meteoro”), a New Mexico Corporation with its principal place of business in Lansing, New York, filed this civil action against defendant, Six Flags, Inc. (“SFI”), a Delaware corporation, on July 31, 2002. An amended complaint was filed November 15, 2002.
