The plaintiff commenced this action in a two count complaint. In the first count, the plaintiff claimed to have an easement over a discontinued public highway and alleged that the defendants had obstructed the discontinued road, thus depriving him of his easement rights. In the second count, the plaintiff alleged that he had aquired legal right and title to the discontinued highway by adverse possession.
