The plaintiff, a building materials supplier, brought this action under § 49-42 of the General Statutes, seeking reimbursement for materials alleged to have been furnished B & G Construction, Inc., hereinafter B & G, a subcontractor of F. W. Brown Company, hereinafter Brown, the general contractor which had contracted with Regional School District No. 4 for the construction of a school. Pursuant to General Statutes § 49-41 Brown furnished a bond in the amount of the contract for the protection of persons supplying labor or materials in the prosecution of the work provided for in the contract.…
