Before the Court for consideration is Defendants’ Motion for Partial Summary Judgment (Doc. 91). This case arises from a vehicle accident involving the commercial tractor-trailer driven by Gregory Wirfel (“Defendant Wirfel”) and the automobile driven by James Burke (“Plaintiff’). (Doc. 57). At all times relative to this accident, Defendant Wirfel was employed by TransAm Trucking, Inc. (“TransAm”). (Doc. 93 at 2.)
