The objections upon the trial relate to the form and substance' of the declaration. The first count of the declaration is as follows:

“ Silas P. Hutchinson, plaintiff in this suit, complains of Ancil K. Whitmore [sheriff of said county for the year 1887], defendant in this suit, who has been duly-summoned to answer the plaintiff in a plea of trespass on the case, for that; whereas, to wit, on or about the 2d day of November, 1887, in the township of Woodstock, in said county, said .plaintiff was lawfully…
