MEMORANDUM OPINION
NEESE, District Judge.
This is a removed, 28 U.S.C. § 1441(a), action for personal injuries, predicated on the diverse citizenship of the parties, 28 U.S.C. §§ 1332(a) (1), (e). The defendant has moved with supporting affidavits for a summary-judgment, Rule 56(b), Federal Rules of Civil Procedure.
