This action arises out of the discharge of the appellant by his employer, the Frigidaire Division of General Motors Corporation (the Company) on July 26, 1972, and the subsequent prosecution of his resulting grievance by the defendant-appellee, Local 801 of the International Union of Electrical Workers (the Union). The appellant alleges that the Union breached its duty of fair representation under its collective bargaining agreement, and invokes the jurisdiction of the court under § 301 of the Labor-Management Relations Act, 29 U.S.C. § 185.
