This is an appeal from a judgment entered on a jury verdict in the Eastern District of Michigan finding for plaintiff-appellee, Aaron Pitts (Pitts), in his action for breach of a collective bargaining agreement and breach of the duty of fair representation brought against, respectively, his former employer, Frito-Lay, Inc. (Frito-Lay) and former Union, Bakery and Confectionary Workers’ International Union of America, Detroit Bakers’ Union Factory Local 326 (Local 326).
