Appellant Nadine Wilburn served for a time as the Interim Director of the District of Columbia Office of Human Rights (“OHR”) and, in 2003, she was on the short list of candidates being considered for appointment as permanent OHR Director. After then-Mayor Anthony Williams appointed someone else to the position, Wilburn sued appellees — the District of Columbia and Kelvin Robinson, the Mayor’s Chief of Staff — under the District of Columbia Whistleblower Protection Act (the “DC-WPÁ”). 1 She alleged that Robinson engineered Wilburn’s non-appointment in retaliation for…
