For the first time, this court is called upon to address the Worker Adjustment and Retraining Notification Act (“WARN Act”), 29 U.S.C. § 2101 et seq. (Supp.1993). It requires some employers — generally those who are curtailing or closing an operation — to provide sixty days notice to those employees who will be laid off or whose hours will be substantially reduced. In 1989, D.H. Holmes Co., Ltd. merged with Dillard Department Stores, Inc., resulting in the layoff of a large number of people — mostly former Holmes employees — whose job functions had become…
