Plaintiff Sidney W. Degan, Jr., brought suit against his former employer and union, alleging breach of an oral agreement to pay special early-retirement benefits and full pension benefits as provided for in the retirement plan and agreement applicable to him. The district court granted summary judgment for defendants, holding that Degan’s cause of action was in substance a hybrid section 301/fair representation suit against both employer and union.
