This is an application for a writ of habeas corpus. We were in some doubt whether, upon the face of the petition and the papers annexed to and made a part thereof, a writ should be granted by this court ; or, if granted, whether, apon the facts stated, the petitioner would not have to be remanded to his former custody. It was therefore deemed best to have an argument on certain points on the application.
