Before the Court is a Report and Recommendation (“R & R”) from Magistrate Judge Tomlinson, recommending th'at the Court grant the defendants’ separate motions to dismiss pro se plaintiffs claims, except with respect to the claims against U.S. Secret Service Agent Joseph Gerbino (“Agent Gerbino”) in his individual capacity.
