This proceeding in error was brought to obtain the review of a judgment of the District Court of Niobrara County rendered in an action wherein Ernest Rosson, the plaintiff in error here, was plaintiff, and J. R. Hylton and G-. W. Earle, defendants in error, were defendants. There was a jury trial and, upon the conclusion of plaintiff’s evidence, pursuant to defendants’ separate motions made for that purpose, the court directed the jury to return a verdict in their favor.
