Damages are sought in this action for alleged malpractice of the defendant, when employed as a physician and surgeon to attend the plaintiff for an injury described as a fracture of the femur bone of his right leg. At the close of plaintiff’s evidence in the district court a verdict was directed for defendant, and the cause is here on error for the review of the judgment rendered thereon.
