The defendant, Joseph Myers, was indicted for attempting to break and enter a certain store with intent to steal. At the trial he demurred to the evidence. The demurrer was overruled, and the jury returned a ver diet of guilty. A new trial was refused, and sentence was imposed. Defendant has appealed to this court.
