Before the court is Defendant Citimort-gage, Inc.’s (“Citimortgage”) motion to dismiss Plaintiffs Neil and Shelly Sarsfield’s complaint pursuant to Federal Rule of Civil Procedure 12(b)(6), for failure to state a claim. The parties have briefed the issues, and the matter is ripe for disposition. For the reasons that follow, the court will grant in part and deny in part Defendant’s motion to dismiss, and will grant Plaintiffs leave to file an amended complaint.
