This appeal challenges a summary judgment entered by the district court dismissing allegations of abuse of process and anti-competitive acts proscribed by the Clayton Act and the Sherman Antitrust Act (15 U.S.C. § 15 (1976) and 15 U.S.C. §§ 1, 2 (1976)). The parties are rival developers of designs for earth retaining walls used near highways and other structures. We hold that appellants did raise genuine issues as to material facts, looking at the record in the light most favorable to the non-movant. We therefore must reverse and remand this action,…
