This controversy concerns the “judicial estoppel” doctrine and its viability in the District of Columbia. After receiving a workmen’s compensation settlement for damages that he had alleged resulted solely from a work-related accident, plaintiff Athanasios Konstantinidis sued defendant Cheng Nan Chen, a medical doctor, for essentially the same damages on a claim of medical malpractice. 1 Relying on the doctrine of judicial estoppel, the district court granted defendant’s motion for summary judgment.
