OLSEN, Justice.
Defendant, M. W. Smith, appeals from an order denying his alternative motion for judgment notwithstanding the verdict, or, if that be denied, then for a neAV trial. By the order, the trial court denied the motion for judgment and denied the motion for a new trial on condition that plaintiff consent to a reduction of the verdict to $8,000. Such consent Avas given and filed.
The action is one to recover damages for personal injury suffered by plaintiff in an automobile collision.
Defendant does not contend that there was not sufficient evidence to justify the jury in finding…
