HUNTER, District Judge.
This is an action brought against the United States and the Interstate Commerce Commission, pursuant to the provisions of Sections 1336, 1398, 2284 and 2321-2325 of the Judicial Code, 28 U.S.C. §§ 1336, 1398, 2284 and 2321-2325; Section 17 of the Interstate Commerce Act, 49 U.S.C.A. § 17; and Section 10 of the Administrative Procedure Act, 5 U.S.C.
