1. Introduction

This ease involves breach of contract and related fraud claims arising out of a contract for the sale of natural gas between plaintiff Kansas Municipal Gas Agency (“KMGA”) and defendant Vesta Energy Company, Inc. (“Vesta”). Vesta has also asserted claims against third-party defendant GasTrak Corporation (“GasTrak”).
