Appeal from a judgment of the County Court of Broome County (Mathews, J.), rendered January 14, 2004, upon a verdict convicting defendant of the crime of assault in the third degree.
Defendant was indicted for two counts of assault in the first degree as a result of an incident during which he kicked, stomped and otherwise assailed a drinking companion. Following a jury trial, he was acquitted of the two counts charged in the indictment but was convicted of the lesser included offense of assault in the third degree.
