This is an appeal by the defendants Maurice Shear (Shear), Richard H. Gens (Gens), and Hyman H. Silver (Silver) from judgments in two actions (see fn. 1) establishing their liability (together with the liability of the defendant Heywood Nursing Home, Inc. [Heywood]), jointly and severally on a promissory note dated February 16,1971, in the face amount of $90,000, payable to the plaintiff, Mechanics National Bank of Worcester (bank).
