APPEAL from an order of the Superior Court of Los Angeles County granting a new trial. Fred Y. Wood, Judge presiding. The facts are stated in the opinion of the court.

The two actions above entitled relate to the same contract and the same controversy. With the consent of the parties and by order of the court, they were consolidated for the purposes of trial, findings, and judgment. The judgment being for the defendants, the plaintiff moved for a new trial. The motion was granted and the defendants appeal from the order.

The object of the action was to recover damages alleged to have been caused to plaintiff by the failure of the defendant, Orange County Nursery and Land Company, to perform a contract with the plaintiff whereby it agreed to plant, irrigate,…
