This is an appeal from a judgment awarding damages to plaintiffs in an action based on fraudulent misrepresentations in connection with the leasing of a resort property. At the conclusion of the first trial of this case, to the court sitting without a jury, judgment was entered for defendant. Plaintiffs appealed from that judgment.

This court reversed the judgment in Salter v. Heiser, 36 Wn. (2d) 536, 219 P. (2d) 574, and remanded the case, stating:

“The judgment appealed from is reversed, and the cause remanded to the superior court, with instructions to reopen the case and grant a new trial…
