In this action to recover a commission of $3,227.55 for the alleged sale of real estate the plaintiffs’ cause of action arises out of the execution by and between the plaintiffs and defendants of two written agreements. The first one executed and dated November 19, 1913, is as follows:

“This agreement, made this 19th day of November, 1913, between Katherine B. Fisk, Emma T. B. Beardslee, and Ovedia A. White, as executrices of the last will and testament, and of the estate of W. E. Lovdal, deceased, the parties of the first part, and Merkeley, Chittenden & Keller, a co-partnership, the parties…
