Smith, as administrator of Ellsworth, filed his *184claim, verified by affidavit against Hawley, as administrator with the will annexed, of Pomeroy, in two paragraphs.
The first paragraph alleges that' on the xoth of January, 1852, and on the 16th of March, 1854, the said decedents entered into written contracts as follows, to wit:
