EUBANK, Presiding Judge.

Mr. John Visco appeals from the judgment and denial of his motion for a new trial entered by the Maricopa County Supe rior Court sitting without a jury. The Court filed findings of fact and conclusions of law in support of the judgment.

Appellant raises two questions on appeal ; they are:
