BACKGROUND:
On May 6, 1999, plaintiffs Shirley and John Hittle (the Hittles) commenced this action with the filing of a complaint, alleging that a fire in their home was caused by a household lighter manufactured and distributed by defendants Scripto-Tokai Corporation, Tokai Corporation, and JMP Mexico, S.A. de C.V (collectively, “Tokai”) and marketed under the brand name “Aim ‘N Flame.” John Hittle is the administrator of the estate of Jessica Hittle, who was fatally injured in the fire.
