January 29, 1909, appel-lee delivered to the Chicago, Rock Island & Gulf Railway Company 141 head of steers, to be transported by said company and its connecting lines from Jacksboro, Tex., to the National Stockyards in East St. Louis, Ill. Appellee accompanied the cattle, and at the time he delivered them to said railway company, in a writing separate from the bill of lading covering them, waived the requirement of the federal statute (Act June 29, 1906, c. 3594, § 1, 34 Stat. 607 [U. S. Comp. St. Supp. 1911, p. 1341]) that they should not be confined .in the cars for a longer period than 28…
