FISHER, Chief Justice.

This is a suit for damages by the appellees on account of delay and rough handling of cattle shipped from Colorado, Texas, to East St. Louis. The suit was originally *350against the Texas & Pacific Railway Company, the Missouri, Kansas & Texas Railway Co. of Texas, and the appellant, Missouri, Kansas & Texas Railway. The case was dismissed as to the Texas & Pacific Railway, and judgment was in favor of the Missouri, Kansas & Texas Railway' Company of Texas, and against the appellant, Missouri, Kansas & Texas Railway Co. for $307.30.
